Welcome to iTixly. These Terms & Conditions govern your access and use of our platform. By creating an account, listing an event, or registering as a participant, you agree to be bound by these terms.

1. Acceptance of Terms

You confirm that you have the legal capacity and authority to agree to these terms. If you do not agree, do not use the platform.

2. Event Creation & Organizer Responsibilities

  • Creating an event on iTixly is free. We charge a service fee of 5% per successful participant registration.
  • Organizers must provide accurate event information (date, time, venue, pricing, descriptions).
  • Organizers are responsible for legal compliance, permits, safety measures, and all refunds or disputes with participants unless otherwise agreed.
  • You must not list illegal, fraudulent, or misleading events.

3. Payments & Payouts

We collect participant payments through our payment processors. Fees and payout rules:

  • We charge 5% per participant registration as a service fee.
  • Payouts are processed every night. We aggregate all successful payments received during the day, deduct our fees, and remit the net amount to the bank account you provided when creating your event.
  • We do not disburse funds per individual registration; payouts are batched nightly for operational efficiency.
  • It is the organizer’s responsibility to provide accurate payout details and to resolve any banking errors with their financial institution.

4. Tickets, Check-in & Access Control

  • Each ticket includes a unique barcode or QR code for check-in.
  • Organizers should establish on-site validation procedures. iTixly provides tools (mobile or dashboard scanning) for instant verification.
  • iTixly is not responsible for access control failures caused by organizer negligence or third-party hardware/software.

5. Refunds & Cancellations

Refunds are managed by the event organizer unless otherwise stipulated in a specific agreement.

  • Organizers decide refund policies and must communicate them clearly on the event page.
  • If an organizer cancels an event, they are responsible for issuing refunds to participants; iTixly may assist with reporting but is not required to issue refunds on behalf of the organizer.
  • Chargebacks initiated by cardholders will be handled according to the payment processor’s rules; any resulting fees or losses may be charged to the organizer.

6. Data Protection & Privacy

iTixly is committed to protecting personal data. This section summarizes our approach; full details are in the Privacy Policy.

What we collect

  • Organizer-provided data: event details, payout account details, identity verification where required.
  • Participant-provided data: name, email, phone number, ticket responses, and any custom fields you collect via registration forms.

How we use data

  • To process registrations and payments, issue tickets, and communicate with participants.
  • To produce reports and analytics for organizers.
  • To detect and prevent fraud, abuse, or misuse of the platform.

Legal compliance

We process personal data in accordance with applicable data protection laws, including but not limited to the Nigeria Data Protection Regulation (NDPR) and the EU General Data Protection Regulation (GDPR) where applicable. Organizers must also ensure any personal data they collect and process via the platform complies with local laws.

Security & retention

  • We implement reasonable technical and organizational measures to protect data against unauthorized access, disclosure, alteration, or destruction.
  • We retain participant data only for as long as necessary to provide the service or comply with legal obligations. Organizers can request data exports or deletion through the dashboard.

Your responsibilities

  • Organizers must obtain any required consent from participants for data collection and processing, especially where special categories of personal data are collected.
  • Organizers must use participant data only for legitimate purposes and comply with their own privacy notices or policies.

7. Limitation of Liability

To the fullest extent permitted by law, iTixly and its affiliates will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data or use arising from your use of the platform.

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Nigeria, unless otherwise agreed in writing.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will notify organizers by email or through the dashboard. Continued use of the platform after changes constitutes acceptance of the updated Terms.
